Terms of Service

I. Subject

XingZap offers users a service to access professional data through AI-powered queries, data sourcing, cleaning, correction, synchronization, enrichment, and duplicate detection.

II. Access to the Site and Services

The platform is exclusively for professionals. Access requires either legal capacity to contract or proper authorization through a legal representative for natural persons.

III. Acceptance of Terms

Users must fully accept these terms during registration. Partial acceptance or conditional registration is void. If you disagree with any part of these terms, you cannot use our services.

IV. Registration

Users must complete a registration form with mandatory information or use third-party login credentials. Registration creates an account for service management. Users guarantee their information is accurate and commit to keeping it updated.

V. Description of Services

XingZap provides:

• AI-powered natural language queries for professional data
• Data sourcing through search criteria and filters
• CSV export of search results
• API access for programmatic integration

VI. Financial Conditions

Pricing

XingZap uses pay-per-query pricing: €5 minimum per query, plus €0.01 per row. All prices are in Euros.

Price Changes

Price changes require one month's notice via email before taking effect.

Payment Methods

Payment is processed via Stripe, which securely retains banking details. XingZap does not store your payment information directly.

Late Payments

Overdue amounts may trigger immediate suspension of services and applicable late fees.

VII. Term and Termination

Services are provided on a pay-per-use basis. Either party may terminate the relationship at any time. Users may terminate by contacting us via email. XingZap may terminate services with notice via email.

VIII. User Obligations

Users must:

• Comply with applicable laws and not breach third-party rights
• Use services personally and not delegate access to others
• Maintain login confidentiality
• Provide accurate and complete information
• Ensure data collection and usage complies with GDPR
• Maintain necessary internet connectivity

IX. User Warranty

Users indemnify XingZap against complaints, claims, and actions resulting from breaches of these terms, compensating for damages and costs incurred.

X. Prohibited Conduct

The following are strictly prohibited:

• Illegal activities or activities that infringe third-party rights
• Sending unsolicited emails (spam)
• System intrusion or security breaches
• Copying site concepts or technologies
• Interrupting or disrupting service continuity
• Reselling or monetizing service access without authorization

XI. Sanctions for Breaches

XingZap may suspend access, delete content, publish warning messages, notify authorities, or initiate legal action for non-compliance with these terms.

XII. Liability and Warranty

XingZap operates under an obligation of means, not results. Services are provided "as is" and may contain errors. Our liability is expressly limited to proven direct damages suffered by the user.

XIII. Intellectual Property

All systems, software, databases, and content are protected by intellectual property rights. Reproduction, distribution, or use without authorization is prohibited.

XIV. Personal Data

Personal data processing is governed by our Privacy Policy and Data Processing Agreement.

XV. Third-Party Sites

XingZap is not responsible for third-party websites' availability, content, or transactions occurring through them.

XVI. Modifications

XingZap reserves the right to modify these terms with one month's notice. Changes will be communicated via email. Non-acceptance requires discontinuation of service use.

XVII. Applicable Law and Jurisdiction

These terms are governed by French law. French is the interpretation language in disputes. The courts of Paris have exclusive jurisdiction over any disputes.
